These terms are an agreement between you and KD Technology Services Pty Ltd (ABN 80 673 305 783), Newtown NSW 2042, Australia, the operator of Domestique. They apply whenever you use the app, whether as a rider or as a member of a workshop's staff, and by creating an account you accept them.
They should be read alongside our privacy policy, which explains what we collect and why, and the marketplace rules, which govern buying and selling between riders. Where those pages describe something in more detail, the detail there applies.
Domestique is a record-keeping and reminder tool. It counts the distance you ride, attributes it to the bike you rode, and tells you when a component is approaching the end of the service life you or your workshop has assigned to it. It keeps a history of the work done, so that the next decision is better informed than the last.
It is not an inspection, a diagnostic, or a safety system, and it must not be treated as one. Every estimate it produces rests on two things: the condition you told it a component was in when you set it up, and the distance Strava reports. Both can be wrong. A chain you judged half worn may have been nearly finished. A ride tagged to the wrong bike counts against the wrong parts. A component can fail through a manufacturing fault, a crash, corrosion or simple bad luck long before any counter suggests it is due.
Nothing in the app removes your responsibility to inspect your own bicycle and to have it maintained by a competent mechanic. If a reminder has not appeared, that is not a statement that your bike is safe. If something feels wrong, sounds wrong, or looks wrong, stop riding it and have it looked at, whatever the app says.
We provide the service on that understanding. We do not warrant that its estimates are accurate, that a reminder will arrive at the right moment, or that following them will prevent a component from failing.
You must be at least 16 years old to use Domestique. Most of what the app does depends on a Strava account, which carries its own age and eligibility requirements, and you must comply with those as well.
During the closed testing period, accounts are created by invitation only. An invitation is issued to a mobile number, is intended for one person, and is not transferable. We may withdraw an invitation before it is used.
You are responsible for what happens under your account. Keep your password to yourself, use one you have not used elsewhere, and tell us promptly if you believe someone else has gained access. If you set an app lock PIN, note that it is held only on your device: we cannot recover it, and forgetting it means clearing it on the device itself.
One person, one account. Do not create an account on behalf of somebody else without their knowledge, and do not use a number that is not yours.
Domestique reads your activities and gear from Strava with your authorisation, granted on Strava's own screen. We do not see your Strava password, and you can revoke the connection at any time from either side.
Strava is an independent service and we do not control it. If Strava changes its interface, restricts access, suffers an outage, or your own connection lapses, parts of Domestique will stop updating until it is restored. Your use of Strava is governed by Strava's own terms, and nothing here alters them.
Because distance is attributed by the bike you tagged in Strava, a ride recorded against the wrong bike will be counted against the wrong components here. Correcting it in Strava corrects it in Domestique.
Domestique lets a workshop you have chosen send you a quote, and lets you answer it line by line. That is the whole of our involvement. Any work carried out, and any money that changes hands, is a matter between you and that business.
We are not a party to that contract. We do not set prices, verify a workshop's qualifications, insurance or licences, inspect its work, or hold funds. Warranties on parts and labour are given by the workshop, not by us, and any dispute about quality, price or timing is one to raise with them.
A quote shown in the app is an offer from that business. Approving a line in Domestique is your instruction to them to proceed, and you should treat it with the same care as you would a signature at the counter.
If you are a member of a workshop's staff using the console, you agree to raise quotes only against customers who have affiliated with your shop, to describe work accurately, and to treat rider contact details as confidential and use them only for the job in hand.
The marketplace lets riders list cycling items for sale and message each other about them. As with workshops, we host the introduction and nothing more: we are not the seller, not the buyer, not an agent, and not an escrow service. No payment passes through Domestique.
Sellers are responsible for describing items honestly and for having the right to sell them. Buyers are responsible for satisfying themselves before parting with money. The marketplace rules set out what may and may not be listed, and how to trade safely; they form part of these terms.
Use Domestique for its intended purpose and not in a way that harms other people or the service itself. In particular, you agree not to:
If you find a security flaw, please tell us rather than exploiting it. We will not pursue anyone who reports a genuine vulnerability in good faith and gives us a reasonable chance to fix it.
Your service records, photographs, listings and messages remain yours. You keep ownership of them, and we claim none.
So that we can actually run the service, you give us permission to store your content, process it, and display it where you have asked us to — a listing to other riders, a message to its recipient, a quote response to the workshop that raised it. That permission is limited to operating and improving Domestique, and it ends when you delete the content or your account, save for backups that age out on their normal cycle.
You confirm that you have the right to provide what you upload, and that doing so does not breach anybody else's rights.
Domestique is under active development and is currently offered to a small group of invited testers. We make no promise of continuous availability. Features may change or be withdrawn, the app may be unavailable while we work on it, and faults are likely — that is the nature of a test, and finding them is part of what we are asking of you.
We take reasonable care with your data, and the privacy policy describes how it is stored. Even so, you should not treat Domestique as the only record of anything you would be sorry to lose. If a service history matters to you, keep your receipts as well.
During testing the service is provided free of charge. If that changes, we will tell you before any charge applies, and you will be free to stop using it.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that the Australian Consumer Law confers on you and that cannot lawfully be excluded. If we are liable under a guarantee that cannot be excluded, our liability is limited, where the law permits, to supplying the service again or paying the cost of having it supplied again.
Subject to that, and to the extent the law allows: the service is provided as it is; we do not warrant that it will be uninterrupted, error-free, or that its reminders and estimates will be accurate; and we are not liable for indirect or consequential loss, loss of profit, or loss of data.
We are also not responsible for the acts or omissions of a workshop, a buyer or seller in the marketplace, or a third-party service such as Strava.
You can stop using Domestique whenever you like, and you can delete your account from the Rider screen. Deletion removes your data as described in the privacy policy and cannot be undone.
We may suspend or close an account that breaches these terms or the marketplace rules, that is being used to harm another person, or where we are required to by law. Where it is reasonable to do so, we will tell you why and give you a chance to put it right first. If we close the testing programme, we will give you notice and a reasonable opportunity to obtain a copy of your data.
We will update these terms as the app changes, and the date at the top will change with them. Where a change materially affects your rights, we will tell you in the app or by email rather than relying on you to notice. Continuing to use Domestique after a change means you accept it; if you do not, you can delete your account.
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state and the courts able to hear appeals from them.
